Course specific prerequisites

This course is only available for students of the Maritime management master's programme.

Aim

The overall aim of the course is to provide the student with a deeper understanding of international maritime and commercial law, with emphasis on international trade, the purchase of transport and marine insurance. The student will also receive in-depth understanding of the technical and economic aspects related to the maritime industry.

Learning outcomes (after completion of the course the student should be able to)

Knowledge and comprehension

1. discuss and comprehend essential convention instruments and various standard form

contracts used in international sale and transportation of goods.

2. discuss and explain emerging legal concepts related to the respective roles of international organizations and industry bodies involved in international commercial, shipping and trade, digital transformation in shipping and trade, and sustainable shipping and trade.


Skills and abilities

3. systematically, critically and independently identify, formulate and analyse questions

regarding commercial shipping and trade from both international and

national perspectives.

4. apply commercial and contract law principles and concepts to specific problems

relating to international sale and transportation of goods and their financing and

insurance aspects.

5. critically identify relevant legal and institutional challenges related to digitalisation,

digital transformation and sustainability challenges in commercial shipping and trade.

Content

The course deals with the legal framework of international trade and transport with particular focus on sea carriage as a substantial portion of international trade is transported by sea. The course covers essential areas of commercial shipping and trade law which is comprised of both international convention regimes and domestic law. Five main subject areas covered under the course are – bills of lading and charterparties, other contracts of carriage including multimodal transport, law of marine insurance, law of international sale of goods, and trade finance law. Emerging legal issues related to digitalisation and sustainability concerns connected to commercial shipping and trade are dealt in the course in contextual detail.

Organisation

The course is delivered in the form of lectures and student-led seminars. A blend of in-person and online teaching is used. The course include formative as well as summative assessment. To this end students are expected to actively participate and contribute to their own and other students' learning.

Examination including compulsory elements

Student performance is assessed by the following components:

- periodic tasks based on the content covered during a week/ module;

- oral presentations and written submissions through group work

- individual home examination

- essay


A student must pass each component separately to obtain a pass grade for the course.


The grading scale comprises: Passed with Distinction (AB), Passed with Credit (BA),

Pass (B) and Fail (U).

The course examiner may assess individual students in other ways than what is stated above if there are special reasons for doing so, for example if a student has a decision from Chalmers about disability study support.
