MMS096 Commercial law or equivalent 

Aim

The aim of the course is to provide knowledge about the rules that governs ship and ship owning companies and also to provide knowledge about some of the most frequently used standard contracts used in ship management and chartering. The aim of the course is also to practice report writing and to apply legal method.

Learning outcomes (after completion of the course the student should be able to)

After completion of this course, the student should be able to:
- interpret and apply law, rules and legal principles that is covered by the course content.
- draft, interpret and analyze, in particular with regards to performance, cost and risk, the standard agreements that are part of the content of the course. 
  • - interpret customs regulations, as well as EU and national legislation;
  • - illustrate differences concerning the import and export of goods;
  • - generalise the concept of customs exemption;
  • - summarise the concept of sanctions;
  • - compare and explain trade sanctions and financial sanctions, respectively;
  • - interpret the significance of sanctions in trade relations with states outside the EU
  • - Reflect on social influence and bias in group work, and describe beneficial structures and strategies for fostering inclusive collaboration within the group.

    Waters and zones. 
    Maritime safety and security. 
    Compliance. 
    Shipowners liability (including pollution) and right to limit. 
    Ship Management. 
    Maritime labor law. 
    Salvage, General Average and towage.
    Custom and sanctions
    Critical thinking, group behaviours, and the group’s influence on the individual’s behaviour and performance.

    Organisation

    The course consists of lectures, literature studies, seminars and  assignments.
    Attendance at the seminars is compulsory

    Examination including compulsory elements

    The course is examined through the assignments, seminars and a concluding digital exam.

    All submitted assignments are graded according to percentage thresholds.

    Below 60%: Fail

    60% - 74%: Grade 3

    75% - 90%: Grade 4

    Above 90%: Grade 5

    The same grading thresholds apply for exams as for assignments.

    The final grade in the course is determined by the weighting of all assessing elements.

    Assignments submitted after the deadline can receive a maximum grade of 3

    Semniars is gradeed pass/fail

    The course examiner may assess individual students in other ways than what is stated above if there are special reasons for doing so, for example if a student has a decision from Chalmers about disability study support.
